Terms of Service

1. Service Description
Matheia is a platform operated by matimenti that enables private tutors to manage students, schedule tutoring sessions, share materials, track invoices, and accept online payments. A student portal gives learners access to their session schedule, materials from their tutors, and invoices.
2. User Accounts
You must provide accurate information when registering. You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us immediately at privacy@matheia.app if you suspect unauthorised access.
3. Tutor and Student Roles
Tutors are independent professionals who use the platform to manage their own practice. Using Matheia does not create an employment or agency relationship between matimenti and tutors. Student accounts are matched to a tutor's records by email address. Tutors are solely responsible for the accuracy of the student data they enter.
4. Subscription and Payments
Premium features are available through a paid subscription (monthly or annual), processed via Stripe. All prices are inclusive of applicable taxes. By starting a subscription you expressly consent to the immediate provision of the digital service and acknowledge that the 14-day right of withdrawal under Art. 27 of the Polish Consumer Rights Act (Ustawa z dnia 30 maja 2014 r. o prawach konsumenta) does not apply once the service has begun. Subscription fees are non-refundable for the current billing period. Tutors who accept student payments via Stripe Connect are independently responsible for their own pricing, invoicing, and tax compliance.
5. Acceptable Use
You may not use Matheia to violate any applicable law or regulation; infringe intellectual property or privacy rights; transmit malicious code or attempt unauthorised system access; or harass, threaten, or defame other users. Violations may result in immediate account suspension or termination.
6. Intellectual Property
The Matheia platform — including its design, code, and original content — is the intellectual property of matimenti. You retain full ownership of all data, student records, and materials you create or upload. By using the platform you grant matimenti a limited licence to store and display your data solely for the purpose of providing the service.
7. Third-Party Services
Matheia integrates with third-party services including Google Calendar, Google Drive, Stripe, Miro, Typink, and Faktura XL. Use of these services is governed by their respective terms and privacy policies. matimenti is not responsible for the availability, accuracy, or conduct of third-party services.
8. Limitation of Liability
To the maximum extent permitted by law, matimenti's aggregate liability to you shall not exceed the total fees paid by you in the twelve months preceding the relevant claim. matimenti shall not be liable for indirect, incidental, special, or consequential damages. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by law.
9. Termination
You may delete your account at any time from Settings. matimenti may suspend or terminate your account if you breach these Terms or if required by law. Following deletion, account data is retained for 30 days to allow recovery, then permanently deleted — subject to retention obligations under applicable accounting law.
10. Governing Law and Disputes
These Terms are governed by Polish law. Disputes shall be submitted to the competent courts of Poland. Consumer users may also seek redress through the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr), the Polish consumer protection authority (UOKiK — uokik.gov.pl), or a local consumer ombudsman (Powiatowy Rzecznik Konsumentów).
11. Changes to These Terms
matimenti may update these Terms at any time. Registered users will be notified of material changes by email at least 14 days before they take effect. Continued use of the platform after that date constitutes acceptance of the updated Terms.
